Personal data is the information that makes it possible to identify a natural person. This includes in particular name, date of birth, address, telephone number, e-mail address, but also your IP address.

Your rights as the affected person

First of all, we would like to inform you about your rights as an affected person. These rights are standardised in Art. 15-22 of the EU-DS-GVO. This includes:

Right of appeal

Please note the following in connection with the right of appeal:

If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without giving any reasons. This also applies to profiling insofar as it is related to direct marketing.

If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection is free of charge and can be made without a form, preferably by e-mail to: newsletter{a}folex.ch.

In the event that we process your data to protect legitimate interests, you may object to this processing at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data, unless we can demonstrate compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms, or the processing is for the assertion, exercise or defence of legal claims.


Purposes and legal grounds of data processing

The processing of your personal data complies with the provisions of the EU-DS-GVO, the BDSG (new) and all other applicable data protection regulations. The legal grounds for data processing arise in particular from Art. 6 EU-DS-GVO.

We use your data to initiate business for pre-contractual obligations, to fulfil contractual and legal obligations, to carry out the contractual relationship (sales contract), to offer products and services, to strengthen the customer relationship (satisfaction surveys, evaluations), to verify your creditworthiness (credit insurance), to establish a job pool as well as for direct marketing measures and marketing purposes (personalisation, selection of offers).

Your consent also constitutes a permission for data protection legislation. In doing so, we will clarify the purpose of the data processing and your right of withdrawal. Should the consent also refer to the processing of special categories of personal data, we will expressly point out to you in the consent, Art. 88 Sect. 1 EU-DS-GVO in conjunction with § 26 Sect. 3 BDSG (new).

Processing of special categories of personal data in the sense of Art. 9 Section 1 EU-DS-GVO is only carried out if this is necessary on the basis of legal provisions and there is no reason to believe that your legitimate interest in the exclusion of processing prevails, Art. 88 Sect. 1 EU-DS-GVO in conjunction with § 26 Sect. 3 BDSG (new).


Transfer to third parties

We will only pass on your data to third parties in accordance with the legal regulations or with the appropriate consent. Otherwise, it will not be passed on to third parties unless we are obligated to do so on the basis of mandatory legal provisions (disclosure to external bodies such as supervisory authorities or law enforcement authorities).


Recipients of the data / Categories of recipients

Within our company, we ensure that only those persons are given the data who need it to fulfil their contractual and legal obligations. This can be done at different locations of the Folex group of companies.

In many cases, service providers support our specialist departments in fulfilling their tasks. The necessary data protection contract was concluded with all service providers. Service providers include, for example, external newsletter senders, credit insurers, parcel services and forwarding agencies.


Third-party country transmission / Third-party country transmission intention

A transfer of data to third-party countries (outside the European Union or the European Economic Area) takes place only to the extent necessary to carry out the obligation to do so, is required by law or if you have given us your consent.

If necessary, we may transmit your personal data to group companies in Switzerland. Compliance with the level of data protection is ensured in line with the EU data protection guidelines.


Storage duration of the data

We store your data as long as it is needed for the respective processing purpose. Please note that numerous retention periods require that data should (must) continue to be stored. This applies in particular to commercial law or tax-related retention obligations (e.g. commercial code, tax code, etc.). Unless there are further retention obligations, the data is routinely deleted once the purpose has been achieved.

In addition, we may retain data if you have given us your permission to do so, or if there are legal disputes and we use evidence within the statutory limitation period, which may be up to thirty years; the regular limitation period is three years.


Secure transfer of your data

In order to protect the data stored by us in the best possible way against accidental or intentional manipulation, loss, destruction or access by unauthorised persons, we use appropriate technical and organisational security measures. The security levels are continuously reviewed in cooperation with security experts and adapted to new security standards.

The exchange of data from and to our website takes place in encrypted form. As a transmission protocol, we offer HTTPS for our website, using the latest encryption protocols. In addition, we offer our users content encryption as part of the contact forms and applications. It is only possible for us to decrypt this data. It is also possible to use alternative means of communication (e.g. by post).


Obligation to provide the data

Various personal data are necessary for the establishment, execution and termination of the debt relationship and the fulfilment of the related contractual and legal obligations. The same applies to the use of our website and the various functions it makes available.

We have summarised the details for you in the above-mentioned Point. In certain cases, data must also be collected or made available due to legal regulations. Please note that it is not possible to process your request or to carry out the underlying obligation without providing this data.

As part of a contact request, we collect and process the following data:

Contact form / Contact by e-mail (Art. 6 Sect. 1 lit. a, b EU-DS-GVO)

On our website, there is a contact form which can be used for electronic contact. If you write to us via the contact form, we will process your data provided in the contact form to contact you and answer your questions and wishes.

In doing so, the principle of data economy and data avoidance is observed by providing only the data that we need to contact you. This is your e-mail address, your salutation, and the message field itself. In addition, your IP address will be processed due to technical necessity as well as for legal security. All other data are optional fields and can be optionally filled in (e.g. for more individual answers to your questions).

If you contact us by e-mail, we will process the personal data communicated in the e-mail solely for the purpose of processing your request. If you do not use the forms offered for establishing contact, no further data collection takes place.


For newsletters, we collect and process the following data:

Optional indication of the address for information mailings


Newsletter (Art. 6 Sect. 1 lit. a EU-DS-GVO)

A free newsletter can be subscribed to on our website. The e-mail address and your name given in the newsletter subscription will be used to send the personalised newsletter.

Here, the principle of data economy and data avoidance is taken into account, as the obligatory fields to be marked are only your e-mail address, your name, the salutation and the language. In addition, your IP address will be processed due to technical necessity as well as for legal security. In addition, we record the relevant area of interest for you. If you also wish to receive samples and information by post, you can provide us with your postal address on a voluntary basis.

Of course, you can terminate the subscription at any time via the unsubscribe option provided in the newsletter and thus revoke your consent. It is also possible to unsubscribe at any time by sending an e-mail from the newsletter to newsletter{a}folex.ch.


Marketing purposes for existing customers (Art. 6 Sect. 1 lit. f EU-DS-GVO)

The Folex group of companies is interested in maintaining its customer relationship with you and providing you information and offers about our products/services. This includes product launches, product changes, invitations to events, satisfaction surveys, news from the companies, free sample shipments. Therefore we process your data in order to send you relevant information and offers by e-mail or by post.

If you do not want this, you may at any time object to the use of your personal data for direct marketing purposes; this also applies to profiling insofar as it is related to direct marketing. If you lodge an objection, we will stop processing your data for this purpose.

We do not use purely automated processing to make a decision.
